On Friday, Rafael Rojas-Gonzalez, 35, of Brooklyn, was arrested and charged with “Forcible Touching, Acting in a Manner Injurious to a Child Less Than 17, and Sexual Abuse,” pertaining to an incident that occurred on November 15 at 7:30 a.m., aboard a northbound 1 train at the Broadway and West 66th Street subway station, police reported.
Rojas-Gonzalez allegedly came from behind and grabbed the buttocks of a 14-year-old girl.
Glad to hear he was arrested. Is this one about which the WSR had reported back in November?
If he is found guilty, I hope he is severely punished for this. He does not belong in public.
But I’m sure someone here will feel bad for him and tell me why I’m wrong.
The charges are class A misdemeanors which upon conviction can result in a maximum sentence of 1 year in jail which is really only 8 months with 1/3 of the sentence reduced for good behavior. Depending upon his prior record, if any, the sentences for a crime like this rarely result in jail time. Also keep in mind that a conviction for Forcible Touching doesn’t require registering as a sex offender.
Doubt that anyone will say you’re wrong.
But maybe too optimistic.
Just read the other day that the guy who choked his “buddy” to death last Feb is expected to plea deal his way to a five year sentence. FIVE years, only, for taking the life of another human being.
So, how “severe” do you expect the punishment to be for a buttocks grabber?
I don’t know the details of that case, but I imagine the prosecutors weighed the plea agreement against their probability of success at trial given the available evidence. That’s usually how it works.
Glad to hear he was arrested. He was attacking a child! What happens now? How soon before he is back on the street?
If found guilty- registered sex offender. He will serve his time and join the ranks of the many other registered sex offender homeless who move from shelter to shelter waiting for placement in perm housing. His status will make it very hard to find work and housing so he will be a recipient of social services. The victim, if she gets justice, will be mentally messed up forever. And thus the cycle continues.
I stand corrected, apparently this can result in a requirement to register as a sex offender if the victim is less than 18 years old.
Congratulations to the police for apprehending this pervert. This is another example of dedicated work the NYPD does to track down and arrest those who are making the city unsafe. They deserve our appreciation for doing a very difficult and often dangerous job.
He may be back on the streets tomorrow thanks to the no bail, go easy on criminals insanity.
