Scent-Seeking Shoplifter Hits Marshalls: NYPD

A petit larceny occurred at Marshalls department store, at 2128 Broadway (78th Street) on Saturday, a little after 5 p.m., the NYPD told West Side Rag. Alphonso Simmons, 58, was arrested for taking $100 worth of perfume. He was charged with petit larceny.

According to the New York Penal Law Section 155.25, a person is guilty of petit larceny when they steal property, generally worth less than $1,000. Petit larceny is a class A misdemeanor.

Thank you for sharing. I’m glad this person was charged. What is the penalty for a Class A Misdemeanor? Is the penalty greater if this is not their first offense? One would hope so but unfortunately I don’t think that is the case so they will likely repeatedly get slapped on the wrist, which is not a deterrent.

He’ll probably get the usual slap on the wrist and will be back at his game the next day. Seems there’s really no real deterrent for these people. Very unfair to shop owners and the rest of us who then have to pay higher prices to make up for these thieves.

It sounds like anyone can walk into a store take something and just walk out with no punishment. Why pay? Jus tell the cashier https://ypdcrime.com/penal.law/article155.php#p155.25d days is a misdemeanor. Like jay walking?

So – you steal 10 stakes from Trader’s Joe, and nothing is done.
You steal $100 worth of perfume and you are arrested and charged.
This really stinks.

I witnessed brazen shoplifting at Marshalls yesterday. A man with a HUGE laundry bag was filling it up with merchandise in sight of everyone! I couldn’t believe it. I went up to the front of the store and reported it. I was told they can’t do anything about it inside the store. Seems crazy to me. But when the thief left with a bag filled to the max, a Marshall’s security person ran after him outside the store, caught him and returned with the merchandise. But nothing was done to punish the culprit. What is going on with this totally brazen shoplifting? Everyone is afraid to confront a thief which gives them license to do what they want to with hopes of not getting caught.

Gail Brewer has nothing to do with this. It may be a federal, state or local law, or it may be an individual company policy (I’m not sure of the origin). But whichever it is, this practice has been around for many decades. It is not a new protocol.

Because of Bail Reform Law this is a catch and release situation. Probably won’t show up to court on the scheduled date. A warrant will be issued. Police will arrest him on the warrant and return him to court. The court will release him again with another return date and on and on and on and…….
