A New York civil court judge on Tuesday issued a decision officially declaring two pit bull mixes “dangerous,” nearly six months after the dogs attacked a chihuahua on a Columbus Avenue sidewalk at West 85th Street.
The ruling by Judge Phaedra Perry-Bond came on a case brought by the owners of the chihuahua and another owner whose dogs were earlier attacked by the same pit bull mixes, Rambo and Zooey. The dogs belong to Upper West Side resident Joseph Columbus, who was ordered by the judge to pay one of the plaintiffs for medical expenses incurred by her injured dogs.
The court ruling was a victory for Lauren Block, whose shih tzu mix dogs were attacked in January in Central Park by the pit bulls. Block’s co-plaintiffs are Lauren Claus and Devon Allen, owners of the injured chihuahua, Penny.
Although the judge did not order Columbus to pay for Penny’s veterinary treatment, Claus told West Side Rag “We’re pleased with the outcome.” But, she added, “It’s hard to be fully relieved, because there’s a long road ahead.”
Judge Perry-Bond ruled for Columbus to be served with her judgement at his “last known address” via overnight express mail by Friday, October 24.
Then, within three days of being served the court’s order, Columbus must contact his local precinct to arrange the surrender of Rambo and Zooey, to New York City Animal Care and Control (ACC).
If he does not surrender the animals voluntarily within this three-day period, the judge has authorized NYPD or other law enforcement officers to “seize said dogs” by “any appropriate means necessary, consistent with the law” – and deliver them into ACC’s custody, court documents read.
Once the dogs are in the “permanent custody” of the city of New York, via ACC, the judge mandated that the dogs be neutered, spayed, microchipped, and “evaluated by a certified applied behaviorist and board certified behavioralist or another recognized expert in the field”– at Joseph Columbus’ expense.
“The court reserves the right to make a finding for humane euthanasia,” Judge Perry-Bond wrote in her decision.
WSR reported on the May incident when Columbus’ dogs mauled a 16-pound chihuahua named Penny; on a subsequent town hall meeting with City Council member Gale Brewer; on the NYPD’s unsuccessful attempt to carry out the judge’s order to take Columbus’ dogs into custody; on the continuing court case; and most recently, the Rag’s Q&A with an NYPD officer who is trained in filing dangerous dog reports.
Prior to the May incident, UWS resident Lauren Block’s shih tzu mixes, Chuckie and Grover, were seriously injured by Columbus’ dogs in a January 2025 attack. Grover was euthanized due to his injuries. Block’s combined veterinary and euthanization bills totaled $21,697.26, for which Judge Perry-Bond’s judgement has now found Joseph Columbus liable.
However, the judge ruled that because Penny’s owners, Claus and Allen, have pet insurance as well as the proceeds from a Go Fund Me campaign that raised nearly $44,000, Columbus was not found liable for Penny’s veterinary bills which have amounted to $12,392.95 as of early October.
“Thanks to the generosity of the Upper West Side’s [Go Fund Me contributions], it [this court case] was never about the money,” Claus told the Rag in a phone interview.
As Claus testified in June: “We’re looking to make this [behavior] harder to get away with in the future. We’re going to use that money to…get better laws passed for dogs.”
Judge Perry-Bond wrote in her decision that “draconian measures” needed to be taken on behalf of Joseph Columbus’ dogs, to “ensure protection of the public.”
The judge also noted that of the nine court dates that transpired between May 27th, when the plaintiffs filed their complaint, and October 2, when the judge scheduled the lawyers’ summations, Joseph Columbus, though repeatedly summoned by the judge, appeared only twice.
Columbus’ lawyer did not immediately respond to the Rag’s request for comment.
His last appearance in court was in early June, and Columbus never testified under oath in the case.

I don’t understand why he hasn’t been arrested yet.
I Have Been Told that he is related to someone in law enforcement. The made-up BS from the sheriff’s dept (“We thought he could only be arrested between 10am and 4:30pm!”) makes me think that might be true.
Other theory: he’s a confidential informant.
I believe he is simply missing. Let’s not make things up.

I fault the owner of these dogs for allowing aggressive behavior. While I’m pleased by the Judge’s ruling that the dogs be removed, humanely, I find it outrageous that the owner of these dogs is not held responsible for payment of all medical bills for these poor victims. Unreal. I hope these pets and their owners are healing well. This is indeed a long road, and significant trauma for these animals and their owners. Wishing everyone the best.
They got 31,000 more than they needed for its care, some of which insurance would have covered. How much more do you think they “deserve “?

I am more concerned how he fled on the sidewalk in his car endangering pedestrians and officers and he doesn’t seemed to be getting charged for it…
the owner should be responsible for ALL the expenses. as for the pet insurance and GoFundMe, the amount should be donated to an animal shelter and not let columbus off the hook.

Unfortunately, I think you’re right. I have a pittie mix who is not aggressive but plays rough. It’s up to me to make sure nothing happens. He’s irresponsible. He should pay all costs, regardless of whether insurance or Go Fund Me paid—shouldn’t be the judge’s concern. Owners have to be criminally responsible. And there should be real consequences.
He is lucky he lives in nyc and boston. No small town would allow him this non white privilege.

I’m not sure how to answer this question, if no one is arresting him, then Everyone is not arresting him.
Great news! Thank you to everyone spearheading these changes! This seems like an important next step in protecting both people and dogs in the city. Of course things aren’t as they should be with holding owners of dangerous pets accountable, but let’s not lose sight that of the fact that this being progress made!

Ugh, terrible. Several potential deaths because of a bad owner.
I know. This is clearly not a case of dogs with special needs and an owner working hard to address them. It makes me see red when owners’ thoughtless, selfish behavior causes so much harm to the creatures who are utterly dependent on them (and the dogs of others).

Wait, where in the world do Go Fund me replace wrongful fees ? Is this done in humans ? Letting the perpetrator off the financial hook because there was a go fund me ? And while they might not be entitled to fees that insurance does cover, any co pays and subsequent fees should be paid out to the victim. This man evaded police when they had an order out in the spring, what makes them think that they will surrender now and the dogs are still at large. Should be immediate.
That is the part the judge got wrong.
No, she didn’t, she correctly determined that Claus lacked credibility because she sought to fabricate a false police report, i.e., she lied. But also that portion of the case is a civil cause of action for monetary damages. If there are none, because the complainant was compensated elsewhere, you don’t get money. Same with workers compensation, if you get paid by workers comp for an injury on the job, you can’t also recover from other sources.
The pit bulls’ owner seems to be displaying a disdain for the law as well as dangerous dogs and carelessness about the damage they have done to others. All the more reason to intervene for an independent authority to assess the dogs, and decide about the next steps for the dogs.

This is wonderful news. I’m sorry it came to this. Based on his track record, this clown is not going to surrender easily. Is he able to appeal the ruling? Seems like the type to take one out of the Trump playbook and repeatedly appeal to stall things. One would hope (though not expect) that if he appeals, the dogs are taken out of his possession while the appeal is in progress.
I do not envy the police officers or whoever else is required to go seize these dogs. I am sure they will not go quietly. I am guessing that finding him and the dogs might not be easy either, though if I recall, he has at least one child so theoretically can’t go too far unless he has already moved.
Please update us as this unfortunate saga continues. I don’t think it will end pleasantly.

They paid for the pet insurance & needed extra donations. The judge shld’ve order restitution, espec. as this was a 2nd offense (if I read this correctly ). I wldn’t let this monster off in anyway.
Well, whatever ACTUALLY happens, I’m glad the ruling/decision was correct. Now we will see if Columbus actually voluntarily gives up the dogs, or whether the NYPD actually forces him to. And although the decision calls for the dogs to be evaluated, and possibly put down, there is no discussion of whether HE needs to be professionally evaluated (mandatorily), since he is obviously a VERY troubled man.
Also missing from the story is the other, apparently fairly solid, allegations against the Columbus’ for domestic and child abuse. I wonder if the NYPD and court are going to look into and address these allegations.
And if “euthanasia” is determined to be called for, it should be on HIM (and maybe it shouldn’t be humane), not on the dogs, which may also have to be put down.

Yea right. This guy has flipped the NYPD the bird 🐦 multiple times (by fleeing on the sidewalk and what not) and they still have yet to even give him a slap on the wrist! I DON’T BELIEVE HE WILL FACE ANY REPERCUSSIONS FOR A SINGLE SECOND!
ZERO repercussions, The Judge and the whole neighborhood can rant and rave all they want. This is Civil not criminal, try suing someone who does not have money in traditional places. Good luck this, guy did not become a fat arrogant a-hole overnight, he has worked at it, he knows the system, I have had interactions with this guy several times over the years, trust me he is not worried about this in the least.
Wish the reporting could have been less biased, leading, and lacking in detail.
