It doesn’t look like it’s a “late night” snack as it clearly is daytime. There are shadows in the photos presumably from the sun.

Good thing this didn’t happen during Mayor Mike’s administration. Poor little guy would have been fined for stealing gov’t property or excessive use of sweets.
