Rosa Mexicano has been sued by the U.S. Attorney’s office for failing to comply with the Americans with Disabilities Act. “[W]hile the restaurant offers alternate entrances for those with disabilities at its Lincoln Center and Union Square locations, both are non-compliant in several respects, the suit alleges. At the Lincoln Center location, patrons with disabilities are directed to an adjacent building to use the restroom, which is still not compliant, according to the suit. Nor does the bar area have any lowered tables or bar areas suitable for use by those in wheelchairs.” Rosa disagrees with the allegations and a lawyer says “They take the diversity of their guests and staff very seriously.” (Observer)

The Americans with Disabilities Act was started with noble intent, but now lawyers use it like the mafia uses extortion tactics. There are so many rules, regulations, and loopholes in that even the most conscientious of business owner can get tripped up in it (and sued for thousands). This seems to be one such case. Not having a part of the bar “lowered” for wheelchair drinkers?
